Recovery in Motion: Participant Terms

Recovery in Motion is offered by Mobia Medical, Inc. (“Mobia”). Please read these Terms before you register. By registering, you agree to them.

What this program is

Recovery in Motion is a group education and peer support program for people who have completed the initial Vivistim protocol. Classes are led live and virtually by an occupational therapist.

This program is not therapy or medical care. It is not occupational therapy, physical therapy, medical care, or medical advice. Attending does not create a therapist-patient or provider-patient relationship with the class leader or with Mobia. The class leader does not evaluate, diagnose, or treat you individually, and nothing said in a class is a recommendation for a specific treatment plan, product, or course of action, or a substitute for talking with your own clinician.

Keep working with your own doctors and therapists. Bring any question about your health, your recovery, or your Vivistim device to them.

Taking part is your choice

The program is free and voluntary. Your decision to join, or not to join, does not affect your Vivistim device, its warranty, or any service or support Mobia provides, and it does not affect the care you receive from your own clinicians. You may stop attending at any time, for any reason.

Before you register

Talk with your physician or another treating clinician about whether these activities are appropriate for you. Register only if you have been cleared to take part. By registering, you confirm that you have done this.

Your responsibility during class

Classes involve physical activity. You take part from your own home, on your own, and no one from Mobia is with you.

You are responsible for:

• monitoring your own physical and mental condition throughout each class;

• knowing your own limitations;

• making your space safe, with clear floor space, a stable chair, and no trip hazards; and

• deciding whether any instruction given in class is appropriate for you.


The class leader cannot watch you individually. You are responsible for your own movement decisions.
Only do what feels safe. If any unusual symptom occurs, stop and consult your clinician. Symptoms include, and are not limited to, pain, muscle strain, dizziness, changes in blood pressure or heart rate, and worsening of a condition you already have.

Risks you accept

Physical activity carries ordinary risks, including injury, muscle soreness or strain, fatigue, falling, over-exertion, and worsening of an existing condition. By taking part, you accept those ordinary risks and agree to stop any activity that is not safe for you.

Emergencies

Keep a phone within reach. If you have a medical emergency, stop and call 911. Do not use the class chat to report an emergency. If you are injured during a class, or you have a problem with your device, tell the class leader and contact your own care team.

Recording, and use of your name and likeness

Classes are recorded.

By registering, you agree that Mobia may record classes and may use those recordings, and your image, voice, name, statements, and likeness captured in them, for education, program review and improvement, and Mobia’s marketing, communications, and publications, including its website, patient education materials, and presentations. This permission is worldwide, ongoing, and royalty-free, and you will not be paid for it.

You may ask Mobia to stop using material in new places going forward by contacting us. Mobia cannot recall material it has already published.

You may attend with your camera and microphone off at any time, and doing so does not limit your participation. If you prefer not to appear or be heard in a recording, keep them off.

Please do not record, screenshot, or share any part of a class yourself. Please do not repeat outside the group anything another participant shares about their health.

Your information

To run the program, Mobia and the class leader collect:

• your registration details, including your name, email address, phone number, and city, state, and ZIP code;

• your emergency contact’s name and phone number;

• your class attendance and program completion;

• your answers to the home activity check-ins; and

• any feedback you choose to give about the program.

These Terms cover the information Mobia collects for this program. Your emergency contact is used only to reach someone on your behalf if there is an urgent concern during a class.

Mobia uses this information to run the classes, to send you reminders and follow-up emails, and to review and improve the program. Mobia shares it with the class leader, who is under a written obligation to keep it confidential, and with the Mobia staff who run the program. Mobia does not sell it. Mobia keeps it only as long as needed to run and evaluate the program and to meet its recordkeeping obligations.

You may ask what information Mobia holds about you for this program, ask Mobia to correct or delete it, or withdraw your agreement to these Terms, by contacting us using the details below. If you withdraw, Mobia will stop using your information for the program and you will no longer be able to attend, because we cannot run the classes without knowing who is registered. Withdrawing does not undo anything done before you withdrew.

Please do not put medical details, or information about other people, in the class chat or in a survey answer.

Changes to these Terms

Mobia may update these Terms. Changes apply to classes held after the updated Terms are posted here.
